The simple agreement

By using CalmYourBaby ("the app"), you agree to these terms.

1. What the app does

CalmYourBaby provides looping ambient audio tracks to help soothe babies and adults. A free tier is available, and a Premium tier unlocks additional sounds and features.

Health & safety notice. CalmYourBaby is a comfort and relaxation tool, not a medical device, and does not provide medical advice, diagnosis, or treatment. It is not a substitute for professional or pediatric care. Always follow safe-sleep guidance from your pediatrician.

Safe listening: Keep any sound machine at a low volume and place the device well away from your baby (general guidance suggests at least 2 metres / 7 feet, and below ~50 dB). You are responsible for the volume and placement of your own device. If you have any concern about your baby's hearing, sleep, or health, consult a medical professional.

2. Accounts

To upgrade to Premium you create an account using a passwordless email code. You are responsible for keeping access to your email account secure.

3. Payments

Premium is a one-time purchase, not a subscription. There is no recurring billing and nothing to cancel.
Payment is processed by Stripe. We never receive or store your card details.
The price, including any applicable VAT, is shown before you confirm payment.
Premium access is granted to your account once payment is confirmed.
Refunds are covered by our Refund Policy, which gives you 14 days to change your mind for any reason.

4. Acceptable use

You agree not to misuse the app, attempt to access premium audio without having purchased it, redistribute the audio files, or interfere with the service's operation.

5. Intellectual property

All audio, branding, and content are owned by us or our licensors and are provided for your personal use only. You may not download, copy, redistribute, or resell the audio tracks.

6. Disclaimers & limitation of liability

The app is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from use of the app. Nothing in these terms limits liability that cannot be limited under applicable law.

7. Termination

You may stop using the app at any time. We may suspend or terminate access if these terms are breached.

8. Governing law & disputes

These terms are governed by Italian law. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory consumer-law provisions of your own country of residence, and you may bring proceedings in the courts of the country where you live.

If we cannot resolve a complaint directly, EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

9. Changes

We may update these terms. Continued use after changes means you accept the updated terms.
